Here, a man raped a woman until she was incapacitated. The human body can withstand quite a lot(I myself have been hit by a bus, electrocuted, stabbed, set on fire twice... you can call me a connoisseur of getting my ass handed to me) so think about just what that means to be incapacitated. this wasn't some drunken one night stand followed by an "oh god, why drunk me, WHY!?" moment(and the subsequent "oh I'd never choose that guy sober" I'll just say rape.) this was literal hours of someone forcing themselves on another until they could no longer even stand on their own.

There is a mistranslation in that article. It was not the judge, but the victim who said that the man may have seen it as 'wild sex' instead of rape.

The court's decision hinges on asking the woman if it could be possible that the rapist could have assumed mutually agreed (if rough) intercourse. She said that is possible. And that kinda threw intention out the window. And that's why he was acquitted. No intention, no rape. Since he vehemently denied intention right from the beginning, and she agreed that he may have misunderstood the situation... the judge didn't have much of a choice.

Btw, that translation is way blogshitposty... whoever wrote that article needs to do their research properly. Mutual agreement in Germany is a word. And that word doesn't translate back to "amicably". The author even acknowledged this when he said "Amicable? When the girl could not even run properly "for the next two weeks"?!"
