Regarding the court case against the old bag, the arbitrary distinction between expressing ones opinion and expressing ones opinion with the intent to convice other people is the matter of intent. You cant proove that she actually changed someones opinion, or that she COULD for that matter, so you go for the criminalisation of the intent to do it.
If you dont have to proove that the person you accuse in court actually changed someones opionion or that she actually could have changed someones opinion that leaves you with a free ticket. There is effectively no burden of proof on you and that is not what criminal law in a civilized society looks like, that is witch trial stuff.

My guess is that the worry is that, despite the wording of the law not changing, people's skins have gotten thinner, so the line for "speech that incites hatred" gets wider. That's why I've never supported laws that use that sort of phrasing. It's arbitrary and changes to the whim of overly sensitive outliers.
