If it's in the User Agreement when you install Battle Net then they have every right to do so since you accepted it.

I might be remembering it wrong, but EULAs aren't really binding in EU. Not like I'm going to sue Blizzard of course, but seems a bit too far gone...

Yeah, it is true. When they updated it you had to agree to it beforehand. But it only scans for software that injects itself into their games though, so not like they'll go through your computer and find your porn.

That's why they always catch hundreds of thousands of bots after they activate tripwire. Though I've heard some cases where tmorph users have been banned in the same waves because it injects itself into WoW.
