I think many companies would simply put a disclaimer that they wouldn't pursue anyone who posts their material. In fact, sites like YouTube can simply refuse to do business with companies that actively pursue users with this law.

edit: I withdraw that statement, the punishment varies by state.

edit2: Holy shit, the maximum sentence for 1st degree murder in Michigan is only 35 years.
