Banned if you play mw3 early?

Activision and IW dont mess around. They dont think twice about taking candy from a baby , even more so once you have paid for the game!
That being said , it looks like they said its ok in an above quote so....

Retailers make mistakes. I work at a place that sells games/movies. We've on more then one occasion sold something early by mistake because they forgot to give us a release date. They are also shady employee's that like to make a quick buck and risk there job by stealing a copy or 2 and selling them under the table.

But if a company is just going to ban people because of someone elses mistake well thats just plain dumb imo.

I'm sorry, but MW3, nor any game, is worth $1,000+. Shit, I wouldn't even buy it half off of $60.
