if you mean the annual pass it works like this: You 'promise' to pay for WoW for one whole year - you don't have to pay for the whole year at once, or do anything special. just pay for wow how you normally do every month if you want. But by signing this contract you will get D3 for free, the mount for wow, and a MoP beta key.
The catch would be if for whatever reason you cancelled your wow account you would lose your access to D3 / mop beta as well.
After you have payed for the entire year of wow, the copy of D3 would be permanently yours.
but yes, technically the annual pass gives you D3 for completely free. It adds no hidden costs or fees. if you were going to pay for wow for the next year anyway there is no reason to not do it as you will get a 50-60$ game for free, a mount for wow, and a beta key... just for being a loyal wow player.
