For pve. Ret palas
for pvp it would be rogues with Vial of Shadows.

I think Rets can still outburst Rogues...It's just that Rogues are unstoppable and Rets...Are.

ret burst is insane, only problem is it's so easy to avoid by kiting.

Here are the weird bits your missing:
Assassination - why are they on top? Wait till you see legendary daggers, if you think Exploit Weakness+Ambushdance is bad, wait till you see Envenom spam
Fury - huge, massive burst potential - but pretty much useless apart from damage
Combat - No'kaled + Vial + Killing Spree + Main Gauche proccing No'kaled some more
Ret - they scale too well with weapon speed because they get so many damage multipliers, but they're very gear dependent and predictable, they always blow all their cooldowns asap when everyone has cooldowns to deal with them still
Enhance - enhance have had good burst for a long time, but the high skillcap means you rarely see really good pvp enhance players

Subtlety is actually the lowest burst potential for rogues in a BiS situation - but Ambushdance as subtlety has the lowest gear requirement. Combat is very RNG burst and not nearly as useful as Subtlety to an arena team or the rogues survivability, Assassination has mostly dissapeared in Cataclysm pvp - but I think it will make a rare and terrifying comeback when you see how hard Envenom hits for, and what it means when a rogue can spam it 6-7 times on you in rapid succession + Vial. Subtlety also has the advantage that its the most predictable burst, while Assassination will still depend on building up their weapon stacks and combat would need to sync procs with Killing Spree, subtlety has a timer until Shadowdance is back.

On the pull with full mastery set buffing Deathwish, no ret paladin or rogue will catchup before their cooldowns are down.

The proc for the legendary takes a huge awhile to ''Build up'' However I'm going to guess if your letting him ''Build it'' You are doing something wrong. Least that's what I got out of it.
