Hard to say. The tape is only one piece of evidence (strong it may be). I'm pretty sure they can't just rule everything out based on it.

I have to say if it showed up in court and I was on the sitting jury I wouldn't believe a word out of her mouth.

The guy would probably get off with it but there's certainly no guarantee.

But that is really the point of marriage. As much as individualists hate to hear about it, we are hardwired to seek validation for our actions in our community. Having a public ceremony where two people state their commitment to be together is an end in itself, as it makes the social ties tighter among all the members of the community. Now are communities are countries, but the need to obtain validation from them is still there.
