Can you play the game without the cd key?

I have been searching for D3 on craigslist for cheap, and someone is claiming to sell the game still in the box, (obviously i only want the cd key to register to my account).

seller said he only played it once, but i think he's trying to scam people who don't know how it works.

if he played it he used the CD Key and therefore not valid. Just pony up and buy it from a store or be smart and don't buy it cause the last time I was on it, it was awful.
Also, yes you have to have the CD Key because you have to register it to your battlenet account when you install same as you do with all Blizzard products.
