    Topless women not breaking the law in NY

    Note to mods: If you feel this is inappropriate then please do delete or lock the thread, or delete the link. I saw this and thought it might be an interesting discussion topic.

    Ladies of New York , you are free to walk bare-breasted through the city! New York City's 34,000 police officers have been instructed that, should they encounter a woman in public who is shirtless but obeying the law, they should not arrest her. This is a good step towards gender parity in public spaces.

    This decision means that breast exposure is not considered public lewdness, indecent exposure, or disorderly conduct. It also notes that, should a crowd form around a topless woman, the officer should instruct the crowd to disperse and then respond appropriately if it does not. Relative coverage is no longer a factor.

    This policy shift comes after several years of litigation and protest. In the 1992 case People v. Ramona Santorelli and Mary Lou Schloss, the New York Court of Appeals ruled in favor of two women who were arrested with five others for exposing their breasts in a Rochester park, holding the law void as discriminatory. The ruling was put to the test in 2005, when Jill Coccaro bared her breasts on Delancey Street in New York, citing the 1992 decision, and was detained for twelve hours. She subsequently successfully sued the city for $29,000.

    In 2007, Go Topless, a national organization supporting gender equality in shirtlessness laws, established Go Topless Day. Dozens of women protest – often topless – in thirty cities around the United States, promoting equal rights to be shirtless. Protests usually include chants of “Free your breasts. Free your minds” and a song “Let ‘em Breathe” to the tune of the Beatles’ “Let it Be.”

    While some who have witnessed these events have suggested that "[t]his is extreme liberalism and why America’s in decline” or “[i]t’s degrading to women,” others have been supportive. One man even said he would encourage his wife to join them.

    Though bare-breasted women might shock the sensibilities of some in the public, it is encouraging to see the police responding positively to gender bias, even on such a seemingly small scale. After all, no one thinks twice about a man shirtless on a summer day. However, the female nipple or chest is still considered “lewd.” By reminding its officers of this, the NYPD is publicly declaring that it will no longer perpetuate unconstitutional gender discrimination, a standard to which all law enforcement should be held and a decision for which it should be applauded.

    There's going to be a lot of hurt sensibilities, a lot of "dur hur boobies", and a lot of agreement. I'm torn on this issue, as it is ingrained in our culture that women's chests are "private parts", but it is also allowed for men to do it and not considered lewd.

    New York indecent exposure law:

    § 245.01 Exposure of a person.
    A person is guilty of exposure if he appears in a public place in such
    a manner that the private or intimate parts of his body are unclothed or
    exposed. For purposes of this section, the private or intimate parts of
    a female person shall include that portion of the breast which is below
    the top of the areola. This section shall not apply to the breastfeeding
    of infants or to any person entertaining or performing in a play,
    exhibition, show or entertainment.
    Exposure of a person is a violation.
    Nothing in this section shall prevent the adoption by a city, town or
    village of a local law prohibiting exposure of a person as herein
    defined in a public place, at any time, whether or not such person is
    entertaining or performing in a play, exhibition, show or entertainment.

    No it is not ok. In the modern world breasts is a sex symbol and is an intimate body part. the chest of a male is not.
    This is where the difference lies, and what makes it not ok for women to expose their chest in public.
    For the women who disagree, please tell me why you cover up when you go out.

    You are okay with it because you see it as a sex symbol, one that you can become sexually aroused by. They don't want that, yet they think that by exposing their breasts they won't get that reaction?

    This is why it is illegal, and should remain illegal. Because, and I'm not saying you, people will see a woman walking around topless and think "Hey, she 'dressed' that way, so she definitely wants it" and will grab / touch / purposely walk into her to feel her breasts.

    I also don't believe the people who say they are ok with it, are going to be ok with it if their moms or grandmothers are going to be walking around bare chested, or anyone else who they don't find attractive.

    Personally, I'd prefer it if both men and women kept their shirts on, but I have no problem making eye contact with shirtless people until they become uncomfortable.

    That's literally the worst written law I've ever seen. Women cannot EVER be guilty of exposure by that wording.

    I'm all ok with this. If it's not lewd and lascivious, than it's fine. Which also means, guys, take up arms and walk naked in the streets of NY, or at the very least walk ass out with assless chaps or something. As long as you aren't lewd and lascivious (google it, it's a law term) it's perfectly legal. Which THEN, if a woman is doing it for attention, or even once flirts topless, its lewd and lascivious and therefor slap her with a indecent exposure and a sex offense. BAM

    But we know NY will never allow this, if it goes to the courts tho, you'll most likely win, and should.

    And that is why it's good.
    Because those thoughts are what are wrong, and need to be changed.
    If it's okay for a man to walk around shirtless (And, in most places in the west it is). Then it should be fine for a woman. Allowed for both, or banned for both.
    The male chest is also a sex-symbol in many occations, just that it can be "everyday". Time for women to get the same.

    As well as start bloody growing out of "She's dressed slutty! SHE MUST WANT ME TO RAPE HER!"
    Girls/women shouldn't be taught "Don't go out, you'll get raped! Be afraid!". Boys/men should get taught "Do not fucking rape. If she tells you to stop you fucking stop right there"

    Hmm, I think it's good that women get the same right (walking around topless) as men. However, I don't really need to see all (though it would scarcely happen that a woman will be topless I guess) those boobs just as I don't want to see all those topless men. Therefore, imo, the law should forbid men to walk topless aswell, but as that won't happen I think this new law is better than no equality.
