    Need Reply For DUI charge

    Hello.. today when i was just going through the newspaper i came across this news for dui charges.. I wanted it to share with you all and wanted to know that what experts think about this case and what would happen next... The guy who was arrested for dui charges crashed 4 cars and some people were injured and he just lost consciousness for minutes, then they took him by ambulance and in the emergency they drew blood that later was 36% for alcohol, then about 12 hours later after he was discharged from hospital they sent him for another samples that was 17%.
    the only point now is the emergency report that only says "patient was in complete consciousness ,the general condition is stable, with no apparent injury and a blood sample was drawn" .
    My question is there a way to find a crack in this case, regading the mismatch between the 36% and the hospital report, and what about the second blood test of 17 %???

    It takes your body quite a while to break down alcohol so it stays in your blood stream for ages. The speed at which it's broken down depends on all kinds of things - your age, weight, sex, metabolism, what and how much you drank, etc. So the 36% -> 17% over 12hrs doesn't seem blatantly wrong.

    As to finding a crack in the case, that makes it sound like you're the accused.

    Personally I don't have a lot of sympathy for those charged with DUI - those injuries could easily have been deaths, all because someone couldn't act responsibly.

    Alcohol leaves the body at about 1 drink per hour, give or take based on body weight and the like. This is why the best thing to do when pulled over is to refuse the test and have it done at hospital. If you only had a few drinks, it will be gone by the time you get there.

    1 Unit per hour. Drinks are variable strengths.

    Btw, it's 0.36% Blood Alcohol Concentration (BAC) not 36% (he'd be dead if 36% of his blood was alcohol, pickled in fact). Also, generally speaking you lose 0.02% every hour after you stop drinking.

    0.36 - 0.17 = 0.19/0.02 = 8.5 hours. So essentially the lowering of the accused's BAC is slower than that of normal. No big deal. Failing to understand what you even mean by "crack in the case". BAC taken at the time is what counts, not the reading when you leave the hospital.

    Edit: In Australia, if you refuse a preliminary breath test when requested to do so you can say goodbye to your licence for 2 years. It's automatic, what you can do however is do the breath test, then request blood be taken instead of an evidentiary breath test (however, blood will generally show a higher reading than a breath test, just saying).

    it's like that here too. refusal to take the test = dui.

    I don't know what "case cracking" you're looking for. Some drunk fuck crashed up, 12 hours later he was less drunk. His license should be taken forever.

    At 36% blood alcohol the individual would be dead. He went from .36 to .17 in 12 hours. One would expect a drop in BAC of up to .18 in that same period of time, so it's about right for the high end of the purge rate. Also, depending on what test was used for each test there could be a difference in how the BAC was determined (whole blood, vs. plasma, vs. breath, vs. urine).
