I believe in a previous post someone mentioned that if you have gear that only has 1 extra stat, like only Hit or Only Exp. with your main stats it could drop below cap. He mentioned carrying extra gear to put on in case that happens. As far as asking "why this was allowed to go live?" I assume that is a rhetorical question.
