People who actually eat the food seem a little underhanded.
In my mind I am either going to refuse the food and payment , or eat the food and pay. (I'm talking about if it is obviously someone else's order or I can see there is something missing/wrong with the dish.)

It's kind of dick-ish to just eat the wrong food. But, a lot of times, you'll just get someone who lets you keep it anyway.

Haha, I just love how the OP puts forth such terrible stereotypes. Guys instantly gets fired, waitresses are hot stuff ... oh god so hilarious.

Anyway, just call a different waiter, tell him or THE HOT FOXY LADY that you ordered something different and that the other HOT FOXY LADDDYYYYYYYYY seems to have an extremely bad day ..

If you're eating in anything even remotely worth eating, they'll simply apologize and possibly give you something from the house.

Heh...now i wonder what would happen if someone ordered a dish with a XXX regent outside (he/she is alergic to XXX) and then waitress says you need to eat what you get on a plate.

    ....btw....i hate mushrums on pizza...ugh...

    I'd start with a simple...

-Hey I'm sorry, but this not what I asked for. (politely, calmly and smiling) If the behavior persists, I'd ask to speak to the manager.

I'm not a fan of throwing hissy fits, unless there is a damned good reason, so a lot would depend on the managers reaction. But very often I found whatever issues I might have had got solved fairly easy by simply smiling and keeping it cool.

    Tell the manager, then leave.

Might as well make sure she is fired.

Not going to give a shit, and just send her back with the wrong order, unless i decide that it's fine for me. Waiters work for tips mostly. Shitty waiter = no tip.

Lawsuit? And depending on the allergy, maybe a criminal attempted murder charge? idk.

I had a somewhat similar experience not too long ago.

I was in a Boston Pizza (sports bar style thing, for those who don't know) and I ordered a new york strip steak medium rare.

First time it's well done, I politely tell my server so, she apologizes, and takes it back.

Second time it's too rare, but I figure "better under than over, it can be cooked a bit longer" I politely tell my waitress so, she apologizes again, and takes it back.

Third time, it comes back, and is well done again. The MANAGER comes out, and asks me how I want my steak, in a not rude, but not polite voice. I politely describe what I want, which is medium rare, or bright pink through-out. The manager seems to take my comment as antagonistic, and proceeds to tell me that my knowledge on steak done-ness is non-existent, telling me the last steak I got was "perfect". I politely disagree with him, at this point the server returns.

The fourth time, the steak is RAW on the inside, as in not even warm. At this point, i'm starting to get a bit fed up, so I call the server over when I see her next. The manager comes over again, and goes on and on about how i'm clearly incorrect (which any fool could realize is wrong). I then tell him "Just give it to me, i'll take it home and do it myself." I wasn't charged, and took it home, and grilled it exactly how I wanted it.

Moral of the story, when you go to a restaurant, you are paying for a service, and if they are unable to provide the service you want (i.e, correctly cooked food) you don't have to pay them a nickel, but it does nobody any good to get overly pissy/angry.

A)What if there was no manager in the bar at that time?
    Example:

    B) In Eu there is no tips (well maybe a little), so the owners need to pay them more. Wich is more *give a F**C* to a costumer than in US. And you cant be fired for the duration of the contract (unles you are a student). Well at least here.

Didn't know that. Where i live waiters get a "barely enough to survive" salary and work for tips. But the tipping is usually generous.

well ofc a normal person would usually just say they got the wrong food and thats what usually happens. But if you had a really bad day feel free to be a dick, right?

You really like posting pictures of your elder scrolls fetish porn mod, don't you?

Here in germany you do give tips btw and I've seen it in italy and the UK as well, so no clue what you are talking about.

what this forums needs is a good long discussion on tipping cultures round the world.

USA can start, EU will respond.

    On your marks, get set.....Go!

USA: You're a d-bag unless you tip at least 20%!
USA: Nuh uh, I don't tip unless good service!
USA: But your server is paid less than minimum wage and it's not his fault that the food sucked...
    USA: NOPE!
Belpala: Rules of life #1, don't fuck with the people who touch your food.
    USA: Shut up.
EU: Umm... why don't you pay your people a living wage to begin with?

I probably didn't get all of the nuance, but that's pretty much how threads about tipping go.

EU doesn't have a proper minimum wage across all member states and/or all jobs either. But that is completly besides the topic, isn't it? A waiter has to behave, like everyone that works with customers, and I'm not even talking about misbehaving customers. If you can't at least treat your normal and neutral behaving customers with respect then the job isn't for you.

Don't get me started on the difficulties of customer service jobs. I might explode. Moving on...

I make sure to look into the customs wherever I travel to ensure people are paid correctly. If the custom is to tip, I tip. That is all.
