It depends on how this went down.
You can't shoot a person fleeing who is unarmed but you can shoot a person fleeing who can pose a threat to others which he could if he was fleeing with a gun.
I think this captured a policeman doing his job correctly. It's good to see this policeman can actually speak to people without using obscenities every other word, as opposed to the police who shot the knifewielding loon in the synagogue in NYC and the police who shot the guy getting out of the car in NJ.

Cant tell what he dropped, retrieved it, and started running again as the officer opens fire at his back.
Gets off 3-4 full shots while his back is directly towards him.
If the cop really and truly knew immediately that was a gun - he's probably in the right though - even though the suspect accidentally dropped it - he kinda looks like he turns back to the officer.
