Contrary to popular belief, gladiatorial games were not generally fought to the death. They were little different from current high impact martial arts competitions and therefore still exist.
No, but I wouldn't mind being able to legally challenge someone to a duel like back in the good ol' days.
We tried that in the uk.
Lets just say after steriod abuse, presenters porking with the gladiators making national news, something as pissy as a leg graze causing hype about show safety, made it clear the idea of having gladiators as a theme was just in name only.
If you are sober, and agree to a duel and get that shit officialized, I say it should be legal.

Ref approves duel. Participants pay admin fee and they get a date and location.
If by the time and place they still want to duel it's cool. If either back out then that is fine and they get it placed on their record.

As for being on topic; the UFC / other MMA is close enough to gladiator fights as we need, really. Anyone who's pining for seeing people kill themselves on some arena has clearly not watched enough MMA.

yes, the benefits of having a military testing ground that's financially profitable are limitless.
the money made off of it's popularity could then be used for research and development of stronger and strong combat related tech.
hell once the era of supersoldiers, cybernetics or genetic engineering(or both!), comes into place you could have duels between demigods as the main attractions.
warfare as entertainment also necessitates further investment into medical development as deaths in the ring are rarely as profitable as the struggle between veteran combatants, gladiators who don't die are worth more then slaughtered masses as people like to have someone to root for..
and hell if you wanted to go completely vegan you could have the fight be between synthetic proxies or digital constructs.
