WC III HD remake VS Private Server

With the controversy here, reddit, and deleted threads on the official
forums, is there really a difference between what both teams are doing?
They both are offering a game that some people want to play. One has
upgraded textures and models, while the other is an earlier version.
The WC III team is asking for donations to help with their project,
and I'm not sure about the Nolstarius team. One has Blizzard approval,
    the other does not.

    You said it yourself.

    - one has blizzard their approval, which makes it legal
    - the other does not, so it is not legal.

    it's obvious really

    Yep.

Need to change the law so the copyright on Video Games expires in 10 years not 50.

Pretty easy solution, I am gonna go to law school because of this.

Well assuming this WCIIIHD isn't a part of Blizzard then I'd say a big difference could well be the former asked for permission.

I think that is what it comes down to, is approval.

This is really all about what Blizzard have given the right to, and what they have not. The new blizzard HD game, is made inside the confided arena, which Blizzard have built in SCII map editor. This pretty much makes it so that Blizzard will always get their cut in the end, since the makers of WC HD will have to go through them first.

The Private server on the other hand, is something that works outside of Blizzards control. If the PS does something, that blizzard does not like, outside of existing, then Blizzard can do nothing to stop them, other then shut them down with legal action. So its a matter about executive control from blizzard and how much that matters when it comes to games.

Well, unless i'm wrong, that fanmade HD version of WCIII is a StarCraft II mod
Isn't it written in the EULA that every Blizzard game mod is associated with the said game ? If I recall well, they sued Valve because of DotA 2 over this reason

I'd rather just have official versions of both tbh. But Blizzard is stubborn and not very bright as of late.

Can we please just stop beating a dead horse? The hd remake has an offical approval, it's even a starcraft2 mod as far as I know.

I thought that WCIII HD is a mod in Starcraft II arcade? It's not even comparable.
Probably running on a Pentium 4

One is a private server of a game you otherwise have to pay Blizzard to play, the other is a mod for a game you've already payed Blizzard to play. Blizzard has a problem with the former and not the latter.

Did you read what you wrote OP? "One has Blizzard approval, the other does not."

As others pointed out, one is approved by Blizzard, one is not. There isn't much else to say, especially since we have more than one thread dealing with the shutdown.
