Double jeopardy is to prevent malicious prosecution, so that would not happen if you implement a solid system to stop malicious prosecution. Double jeopardy is fine for non-serious offences, but when it comes to things like murder it should be within the power of the state to make sure that justice is served and people do not get off on technicalities.
