Yeah it is a technicality that has little meaning in law. It could be a good move if you're at a party and you want to dissociate yourself with the contraband. In this case, they apparently saw Brown himself throw it. He would've been better off leaving it in the house and saying it isn't his. Of course that would be expecting too much.
