It's more likely that the actual owner sold his account and stole it back. Hackers usually just empty your gold and leave.
If the account was hacked OP could not have known this, so he deserves his money back.
Oh and if the trade was illegal then the payment must be reversed too, even the law says this. If you sell stolen goods you don't get to keep the money.

Knowingly buying stolen goods is illegal and not only will you not get your money back, you could face criminal prosecution. Unwittingly buying stolen goods that you know to be dodgy (but not necessarily stolen) is a bit more of a grey area. You're unlikely to face criminal prosecution, but you are not entitled to get your money back. The fact that his action goes against a very clearly stated ToS by Blizzard means that he has forfeited any rights to expect anyone else to return his money.
Should the scam site return his money? Of course. But why would they? They are a scam site.
Given the OP was scammed out of 250 Euro, someone in the scheme has clearly committed fraud, which is a criminal offense.

There are no EU-wide rules for faulty digital content. Account trade is a digital content.
Only thing that could work is lawsuit or chargeback here.

Unfortunately this is quite often the case: the seller of the account is the legit owner, gets paid his money by the website. Calls Blizzard and lies and says 'compromised account' so they reset the password and the seller gets his account back and keeps the cash. The guy that paid for it is the one who loses out as he has lost both his cash and the account he paid for. Play with fire and you risk getting burnt,

I've lost my original WoW account, with quite a few decked out chars back in MoP, email attached to it was hacked so figure it wasn't much of a task to steal it, wouldn't be surprised if it ended up on an account selling site, can't feel sympathetic to your loss of cash.
