    The big issue appears to be whether the legal maneuvers used by the plaintiffs (voluntarily dismissing their lawsuit in order to immediately appeal denial of certification of class action) is permissible. From the first article:

    I have never had my disc get scratched while it was in the console.. unless I accidentally bumped it or moved it while it was moving. The part where they say that the console couldn't even vibrate while scratching their disc. You want to know what happened? A bunch of angry people who throw their controllers probably threw their controllers at their furniture where the console is, it shook, and scratched the disc. And now they claim it's defective. For what reason would you ever want to move your console while it is on?

    I never had a problem with scratched discs. The issue I have with basically any and all consoles is that their optical drives are weak.

    I game hard, much like i'm sure most of us do. On the weekends, I might log around 20-30 hours. Well, my PS3, Xbox360, and Xbox One all have dead optical drives.

    The XB1 had a dead optical drive within the first year of owning it. I have absolutely no luck with them at all. So at this point, my entire game collection is digital.
