As far as i know it is based on your crit at the time of the current tick.

If it was based on crit at the time of application you could just use Cold Blood and have 100% crit chance all the way. If only :P

Except rupture doesn't consume cold blood.

The chance for your rupture to crit is based off of the crit chance you had at the time you applied it.
