Flagged for flying?

I haven't been in wow in a very long time so I knd of forgtten a few things.

I was flying around in Twilight Highlands with my Druid who is not an 85. While flying I was shot at by an npc causing me to get flagged. So I'm thinking it had to be a guard from the opposing faction, right?

But, unless you fight back aren't you not suppose to get flagged? I recall getting hit by opposing faction npc's but I don't recall ever being flagged unless I fought back.

So is this something new now where you're flagged automatically whether you fight back or not?

Yes you get flagged by npcs at random sometimes, like when i used to stand on the goldshire roof waiting for people to finish a duel. As soon as i was seenby the guards, i would get flagged. Weird.

If you fly over the camp of the opposite faction you become auto flagged. Happened to me on my DK while mining.

I had this problem too waiting for the darnassus boat as a hordie pre-4.0.3. Doesn't happen all the time though.
