The recording device was not transmitting the information directly to the adult. It was in the control of the student.

Facing up to 5 years trying to protect your child, how crazy this world we live in were real criminals go free on a daily bases.

What she did was wrong. That said, I don't think she'll get 5 years for it at all.

Nothing to hide. Growing up in a household that kept an active tab on my activities made me bluntly honest.

Again, teens and children don't have a right to privacy. That is how you end up with kids knocking people up, smoking weed, and getting into trouble because they hid crap from their parents.

Sad diversion. Even though you think it's right to spy on other people's kids, please don't do it. That's all I want to come from this thread is to stop someone like you from spying on other people's kids just because you think they have no right to privacy.

They may not have right to privacy from their own parents, but they certainly have a right to privacy from random other adults.

As the article stated, Virginia's a one-party-consent state, which means as long as her daughter consented to the recording device, any conversation with her daughter that the device recorded is perfectly legally recorded.

It's only the possibility that it recorded other conversations her daughter was not party to that could have broken the law.

Which is why the line of the article "She sent her daughter to school with a digital audio recorder in her backpack, hoping to capture audio from the classroom. School officials found out and confiscated the device, which had been in her daughter's desk recording the school day." is going to make or break the case.

If the daughter left a recording device in her desk and she wasn't present, the charges likely will stick. Going to lunch, the restroom or even being too far away could give the prosecutor enough grounds to win.

Important lesson here - keep your recording device on your person at all times.
