Suspects in Danish sex video case should be treated 'with caution': lawyer

The young age of the over 1,000 suspects in the Danish sex video investigation means special consideration should be made by police investigators, a defence lawyer has said.
Police have summoned young people for questioning over a wide-ranging sex video investigation without informing them why they are to be questioned.

Earlier this week, the investigation of over 1,000 people over the distribution of two explicit videos and one image was announced by Denmark’s National Police.

But police risk harassing those under the spotlight for digital harassment, Copenhagen defence lawyer Janus Malcolm Pedersen told news agency Ritzau.

A total of 1,005 young people are currently suspected by police in connection with the case, in which police have in several instances summoned suspects for questioning without informing them of the nature of their inquiries, Pedersen said.

“If the suspect or his or her parents call and say they don’t want to attend the interview, they are often told that police will have to go and pick them up,” the lawyer said to Ritzau.

“That is a threat that works on most people. Not many want to be the one getting put in handcuffs and taken away by police. Especially not if you are 14-15 years and the whole class is watching,” he added.

The many suspects in the case are accused of sharing two explicit videos and one image using Facebook’s Messenger service.

Although the legal age of consent in Denmark is 15, The country’s criminal law forbids possession and distribution of photographs and videos of a sexual nature of persons under the age of 18.

Individuals under police suspicion in the case may have broken Danish child pornography laws, police said in a statement on Monday.

“In my experience, most people in this situation will be overwhelmed by discomfort, shame, panic or the need to explain themselves, so that it can be dealt with,” Pedersen said.

Many do not take in police advice that they have the right to legal representation and to remain silent, which could lead to serious problems further down the line, according to the lawyer.

“Considering that children and youths are under suspicion… it is my impression that these cases should be managed with just as much caution with regard to suspects as seriousness with regard to victims,” he told Ritzau.

Conviction for distribution of child pornography can result in up to two years in prison under Danish law.

Since Monday’s announcement, victims of revenge porn have come forward to talk about how they hope the major investigation will help others to speak about their experiences.

“It is clearly positive in my eyes that these charges are coming forward. It is something that makes me, as a victim of revenge porn, feel as though I am being taken more seriously than I have ever been before,” Sofie Slangerup said to newspaper Politiken on Monday.

In announcing the investigation, police said that they hope it makes young people more aware that explicit images of this kind are illegal to possess and can result in criminal conviction.

“We are under the impression that young people are well aware of the consequences for victims of sharing material of this kind. But they possibly do not know that it is illegal and that they can be convicted for distributing child pornography,” National Cyber Crime Center (NC3) superintendent Flemming Kjærside said in Monday’s press statement.

“If you receive a criminal conviction as a minor it can stay on your record for it least ten years. That means you cannot get a job in a daycare or as a football coach. If American authorities are informed, it can also cause difficulties with travelling to the USA. So this is serious and has serious consequences far into the future,” Kjærside said.

Fuck treating them with caution! They're criminal scum, they don't deserve any caution just because they happen to be young!

Individuals under police suspicion in the case may have broken Danish child pornography laws, police wrote.

The material contains sexual images involving persons under the age of 15 years at the time of recording, the Danish National Police (Rigspolitiet) confirmed in a press statement.

So they either did or didn't and how the fuck are over a thousand people being dealt with for sharing a video? what about the idiots that actually MADE the video, I guess as usual they will get away with it since making the stuff seems to be legal if you're underage yet if someone else looks at it then it's illegal.

The article is still misleading, is it a group of people sharing CP? was it a couple of kids making a video and sharing it around that got out of hand? "may have broken CP laws" then goes on to say they are under 15 which in the same article states IS breaking CP laws, this article is a cluster fuck. Never read an article in my life that made me come away with more questions than answers like this.

They could be trying to scare off other kids from spreading that kind of stuff around by making an example out of them, even if they just intimidate them and then only slap them on the wrist? I could be confused by the article but it sounded like a bunch of teenagers were sharing and spreading around some sex videos that're probably between some classmates, the way nudes tend to float around a school if you're dumb enough to share them with someone.

Basically a few kids make an explicit video and shared it with their friends. Eventually someone informed the parents of one of the minors in the video, and now the parents are demanding the police not only investigate it, but charge every minor that ever shared it under CP laws.

I doubt it, how scared would you be from a slap on the wrist? would it make you never do something against just in case absolutely nothing happens to you just like nothing happened to them? the entire article and investigation seems brainless, hell if you start investigating school kids spreading nudes around then you will wrack up thousands of investigations and convictions on a monthly basis.

And this is the bit that boils my piss, charge every minor while the people that caused all this get nothing? blame everyone else for what your own child did? bullshit.

I did say "even if they just slap them on the wrist". I dunno how far they would be willing to go to punish them but from the other article it sounded more like they are trying to raise awareness for the fact that it is illegal to share such things, rather than them trying to crack down on child porn distribution against a bunch of kids

Raise awareness that's already there, pretty sure everyone around 15 should know what CP is and what's illegal regarding that, this sounds to me that the parent of the people responsible has some power and all this smacks of some dick measuring contest. Nobody will ever be charged with anything and the people that created it all, ie made the illegal content will never be punished, all in all this year investigation wasting thousands of hours and thousands of Danish currency will solve absolute piss all because guarantee the kids in Denmark and all over the world will still do this regardless of any outcome.

What about the young folk that made the video? isn't what they did by law producing and distributing child pornography?

Yet there's no mention of the people responsible anywhere is there? they didn't seem to break any law even though they produced and originally distributed it.

I 100% agree, unfortunately in these situation the creators of the video somehow turn into the victim rather than being considered morons who made and shared this shit. It's unreal, I have a female cousin that shared a nude selfie with a classmate while underage. Basically the recipients parents saw it and told the girls parents, then my aunt and uncle went so batshit crazy that they almost got the boy expelled because he was "in possession of CP" all because they thought he was tarnishing daughter.
