The judge could not apply the law (he did in fact : he could not sentence the guy) HENCE WHY THEY CHANGED IT.

Essentially, if the victim is not chained to a wall and screaming, it was previously impossible in lots of juridictions to prosecute it as sexual assault (''rape'' being quite a misnomer, as in some US juridictions, non-missonnary sex does not count as rape)
