what makes a war crime a war crime??

Is it really just based on the winner of a conflict to you, personally? Like if there was an American war hero that personally tortured and brutally killed or desecrated all the Nazis he could along with butchering civilians under the justification "Germans aren't humans", would you see that man as a war criminal even if you're an American and he is listed in many major victories?

Like to the country, someone that does evil things for its sake can be seen as a hero, so from their POV they aren't "evil" or war criminals.

A war crime is when you violate the rules of war.

If you're playing tag and someone runs into the bathroom and locks the door, that would be an example of a war crime.

A war crime is an act that constitutes a serious violation of the laws of war that gives rise to individual criminal responsibility. Examples of war crimes include intentionally killing civilians or prisoners, torturing, destroying civilian property, taking hostages, performing a perfidy, raping, using child soldiers, pillaging, declaring that no quarter will be given, and seriously violating the principles of distinction and proportionality, such as strategic bombing of civilian populations.

Danerys burning King's Landing. Everyone recognizes she had valid military goals, but it's that she exceeded those goals, wantonly slaughtering harmless civilians.

War crimes are war crimes. Americans or any one else who excuses war crimes on the basis that the atrocities are committed by people of the same nation as them are complicit in those war crimes.

I would go to say that dropping warheads on foreheads is a war crime: but I mean, all the boomers say they were the great part of history and everyone after them are all failures so.. yeah - warcrimes are based on whatever people that win decide

No. War crimes are usually very clear violations of human decency. Like shelling Iraqi villages with depleted uranium and creating unheard of birth defects for generations.

War crimes and international laws were created to protect stronger nations. In theory, war crimes are horrible, but in practice, war crimes are committed all the time, but the UN or whatever usually ignores when their own members commit it.

I'm an "American" and yes that would be a war criminal.
The moment you justify that your enemies aren't human, to commit horrible crimes against them, then yes you're no better than them.

I have friends who actually defend her actions, saying that she suffered so much.

A war crime is any action in war that the winner determines was not within their interpretation of existing international law.

    Legal basis for this view?

A war crime is when you're trying to date on Tinder and the first line you read is "I hope you're well hung"

To you? Unless "you" is referring to the Geneva convention this really is quite pointless. War crimes are very well defined so you might as well ask how you feel an apple is.

Incredibly, almost insanely stupid thing to say.

For instance, napalm was heavily used against Vietnamese civilians in the 1960s but not outlawed by the international community until the 1980s.

    Breaking the rules of war.

    duh.
Human progress isn't measured by industry. It's measured by the value you place on a life.

In theory, crime only matters if it can be enforced. The losing side of a war cannot enforce a war crime. So war crimes are determined by the victors.

Yes of course that's a motherfucking war crime how is that even a question.

Violation of international rules of war are war crimes, no matter which fucking country they are from. Sadly, people from "certain" countries get prosecutes way less than they should.

Pure nonsense she did what people do in war. But because it’s part of a story and the audience feels their emotions should dictate the story people can’t shut up about it.
