I agree, IF it stays open.

    Why?

There's no minimum requirement. McConnell can do it in literally one day.

Help me out in the Trump thread... am trying to say the same, since people are acting like it’s the end of the world.

So, uh, the election just got a lot more dire. Vote Biden or condemn the US to conservative rule for the next ~40 years.

The only thing I learned from that was that Democrats could have prevented Clarence but played too nicely. Otherwise, I don't see how they can prevent it from going through in a day.

rush the nomination immediately after the election as courts issue injuctions for/against counting mail-in ballots, leading to a 5-4 opinion declaring Trump the victor

That's a good point. Even if Trump can't rush in a nominee before the election, he still has until January to do it. So he has almost 4 months to push one through.

They put it first on the agenda, McConnell can immediately motion for cloture, and they vote on it. I'm not saying they will or even need to, just pointing out that they could. They still have nearly 4 months to get this done.

    Who's ready for a 269-269 EC split decided by a 4-4 SCOTUS?

They don't need two months, they have until January. If they do attempt fill the seat, and I don't anyone would put it past them, I don't think theyll do it until after Nov 3rd unless it invigorates Republicans...which it probably will. We know how united Republican voters got last time they were within arms reach of a seat and there's no honor among the Republican Senators not grab at the seat on their way out.

Hitting them with "what about letting the voters choose" will be met with, "the voters voted for US to do this job and our terms aren't over yet."

But it's not the time to panic, to cry, to fall apart, to throw in the towel. It's time be smart, attentive, participate, and vote.

The GOP wants, needs the left to assume defeat right now, that way they can steamroll whoever and however they want they want. Maybe went some down ballots while they are at it. The vote is more powerful than ever right now though.

They can do their song and dance, they can steal the seat, but not without consequences. If they do it it's up to voter to make sure those Senators will not have a seat come January 31st. That when future officials are face with certain situations that it's going end with their party being defeated in the elections.

The suck is over. This possibility of this happening was known 4 years ago, we've had time to prepare for it.

If that happens, and the house is able to win just a few key districts, then Pelosi becomes president, improbable but technically possible.

Districts don't matter. If the presidential election goes to the house, they vote by state, not individually. California's delegation gets 1 vote, Idaho's delegation gets 1 vote, etc.

Its known that the Republicans have the upper hand in the unlikely situation that it goes to the House.

I know, but if they win a few key districts than they have the majority of states on their side, which they currently don't.
