    EU rules publishers cannot stop you reselling your downloaded games.

    Hurray for us consumers in Europe. Does that mean selling b.net/wow accounts is now legal in Europe though?

    old, blizzard can still ban the account if they deem necessary.

    If you can legally sell your account, Blizzard cannot ban it just because you sold it. That decision would be against the EU regulations and Blizzard could be sued to take the ban away.

    Very interesting decision indeed.

    Yes, they can. Blizzard can ban you at any time for any reason.

    A ban is essentially a private decision. They retain the right to do so for whatever reason they deem necessary, including trading of the account. I don't believe selling accounts was ever illegal. It's just against Blizzard's EULA, what they're using to ban you.

    If Blizzard's EULA regulations are violating the EU regulations, then the EULA regulations cannot be applied. So simple as that.

    You still cant sell a wow account because 1) Blizzard does not sell WoW license, they sell the pass to access the servers 2) the characters and your account are Blizzard property so they can ban you whenever they want, for whatever they want. Other games are a whole lot different story though, but you still cant sell your battle.net account because you cant change the owner therefore you cant make it unplayable for you (technically the account and the games attached would still be yours). This requires a mechanism to move games over battle.net accounts, which is not implemented yet, even for moving games across accounts owned by the same person.

    Unless they've suddenly ruled against 'we can ban you whenever we want to protect our game', that's not especially relevant.

    In theory, yes. In practice, it'd take a lot of time, effort and money to seriously contest something like that. Nor would there be a guarantee of actually succeeding thanks to the numerous loopholes that could and likely would be exploited.

    There is one condition, however. If you resell a license to a game you have to make your copy "unusable at the time of resale". Now you will do that, won't you?
    License needs to be inactive for you to be able to resell said game. What this means it that first you would have to contact blizzard to have the copy/license removed from your account before you are allowed to sell said copy. So no you cannot sell you wow accounts legally.

    Just like the other thread, how people are getting "WoW accounts" out of "downloaded games" makes no sense at all. You can resell your Steam games according to this regulation. You in no way can resell your WoW account which a) still belongs to Blizzard and b) your account isn't a "downloaded game."

    All this means is Blizzard can't take legal action against people selling accounts. Banning them is still possible as it's a private decision.

    Remember, playing this game is a privilege, not a right.

    Probably it could take some time if there was a litigation taken to a court with such a case against Blizzard, but the question is put and it's a serious one. And you need only one decision from the EU Court on such a legal question to impose its interpretation all the courts of the EU countries.

    You cannot sell your steam account.. But you can sell steam game license's of downloaded games. Same works with battle.net. You cannot sell you Battle.net account, But you can sell blizzard games license's. (IF they were downloaded games.) But to get them to first inactivate the license from your account is prolly gonna take you a bigger time then its worth as it will basicly give you a blank version of cataclysm to sell. (Using cataclysm digital/downloaded version as example)

    They can take legal action as selling an Account or a License of a game is a different thing. This new ruling allows you to sell the 'license' of the game, given that its inactive at the time of resell. When attached to your account from a legal point of view its counted as active. Therefor you cannot sell the game aslong its attached to the account. Also removing said license from your account automaticly means that there blank once again meaning you can pretty much only sell it for vendor price and lower.

    I'd be really interested for someone of wealth to take Blizzard to court and see them try to sell their WoW account (or any "service") to another party. I don't think it pertains to any "accounts" (in any game) purely because at any time said "accounts" can be banned. So I don't see how selling something which you inherently DON'T "own" without risk of losing it (banned) could be resold.

    It's nothing more than trying to sell a car that you are leasing. You can't. You don't own it. You COULD sell the gas that's in the tank though.

    These are questions which will be discussed if such a matter is taken to the Court.

    All you would be able to sell is the WoW license attached to the account, not the account or any characters on said account. The license just lets you play the game, the account is what blizzard "loans" you to be able to use the license you bought and in not in any way able to be sold as it does not belong to you. Good luck trying to get Blizzard to detach your WoW license from your account though.

    Pretty much this. What is important in the ruling though that by law, Blizzard must faciliate to that now somehow.
