    Those are picked by the religious groups in question, not by the state.

    Oh boy, here we go again. Right so let's quote the National Academy of Sciences on what "scientific theories" are:
    Theory: In science, a well-substantiated explanation of some aspect of the natural world that can incorporate facts, laws, inferences, and tested hypotheses.

    Now, as we can see, theories can contain facts and tested hypothesis within them making them well-substantiated.

    To go further, the next paragraph:

They are understandings that develop from extensive observation, experimentation, and creative reflection.     Theories are not "below" facts in some form of scientific ranking order, they even incorporate facts. There is so much evidence of evolution's occurence that it is one of the strongest theories around, not to mention without it our medical understanding would be leaps and bounds behind where it is right now.
    The hypotheses regarding evolution are tested and found accurate.

    "Theory" in the common tongue would be a "hypothesis" in scientific terms:
    Hypothesis: A tentative statement about the natural world leading to deductions that can be tested. If the deductions are verified, it becomes more probable that the hypothesis is correct.

    What's funny about this is that Evolution IS a scientific fact. That evolution occurs is beyond debate.
