This is an interesting one.
So the ACLU is suing Trump and a whole slew of others because Trump ordered protestors cleared from Arlington. You know the deal: rubber bullets, tear gas, Bible upside-down, etc etc fatass.
Biden's DOJ is asking for the lawsuit to be thrown out.

And, well, it
kind of makes sense. For one, the DoJ says that Trump can't do it again so it's like the election lawsuits that were thrown out because the states certified. So a lawsuit that says "Trump can't do that" is moot.
"...okay but..."
And two, they argue that Trump and other WH officials may have
ordered the actions, but the police were the ones who
did them. And I guess,
technically, Trump was not actually in charge of the DC police. It would be similar to the SS shooting at someone to protect Biden, missing, and hitting a bystander. You couldn't sue
Biden for that.
In essence, Biden
could be making these arguments in case he, oh I don't know, needs to
clear a murderous insurrection. If a second group of treasonous killers try to rush the Capitol or WH to end the lives of duly elected officials, Biden could say "Well, tear gas and rubber bullets worked last time", order the DC police to open fire with impunity, then say "Look, we have President, it was fine when your guy did it".
"But...Trump used damn near lethal force for a photo-op! Any hypothetical Biden might not even need to do isn't relevant!"
Well it's possible the judge won't agree to the DoJ's motion and allow the ACLU's lawsuit against Trump to continue. There are also three other lawsuits about the same issue brought by others, such as BLM. I might be mis-reading this, but I think the DOJ is only arguing one of those four lawsuits now.

I agree. The ACLU even said law enforcement "could have used live ammunition to clear the park, and nobody would have a claim" based on the DoJ's argument.

So just to be clear: Trump, praiser or torture (yeah I can link that too) and hater of democracy, ordered the DC police to use violent force to clear peaceful protestors, so he could walk a block, hold up an
unopened Bible upside down, then walk half a block back to his bunker. Yes, the DC police did it and they didn't technically have to. Maybe if Trump had used the SS then Biden wouldn't be defending him. We'll never know. But Trump gave the order. He was a dictator, he was a sociopath, and most importantly, he was a craven whore-fucking coward.
Maybe this particular lawsuit won't be the one that does it, but I want to see consequences on
him, for
his actions. Using damn near lethal force on peaceful protestors isn't even the most unAmerican thing he's ever done, but it's far beyond "bad enough".
