And that will be a death-knell.

    It takes a while to get any form of clearance. You know what speeds that up? Applying. Nauta's lawyers are asking for an extension because they ignored Cannon's orders in the first place.

    The latest request made by Nauta’s team did not suggest a new date for the hearing on the handling of classified evidence in the case, only arguing that the Justice Department and Nauta should find a time that “is mutually agreeable to all necessary counsel of record.”

    It's nice to see Smith firing back, but I was under the impression that once "Nauta's" lawyers went from "indefinite delay" to "next week" he got on board with the delay.

    As for Cannon delaying the trial... she's not going to just dismiss the case. If it happens (which is my expectation, although we have few indications of if her behavior has changed), the official paperwork will be filled with "unique circumstances" and "in cases where a date would create unreasonable hardship" (and completely ignoring how Trump has deliberately created the situation) she'll find further excuses for delay.

    So what's funny is I'm listening to the Ultra podcast Rachael Maddow did about that time American Nazis tried to overthrow the US a few times before WWII and I gotta say. It really is remarkable how little right wing legal bullshit tactics have changed since the Nazis were doing it in the 40's. Just delay, delay, delay, cause chaos whenever possible, make pointless filings, play innocent despite everyone knowing what they're doing, openly trolling the court who have to pretend to pure neutrality.

    Really interesting how little some things change for the far right, which does seem to find themselves in US courts a lot.

    Tuckers viewership has cratered. It's still reportedly around 3.8 million which isn't bad! But the way viewership works it's also not as great as it seems as the Fox numbers are higher than reported with reruns and clips viewed online etc. Either way it's lost 86% of his viewership since he started his Twitter show.

    Doesn't seem to be going great in MAGA world!

    Cucker Tarlsons viewers had to switch from simply turning on their TV to using another device and finding his show. Not surprising to me at all that he lost 86% if them.

    I "watched" a lot of twitch when they still had a desktop app. It started up with my pc and I would have it in the background, sometimes even with sound turned off. Still counted as a viewer. It would be no problem to have it in a browser... but I simply don't. Can't be arsed to open a tab with it.

    The Justice Department (DOJ) said Tuesday it will no longer defend Trump as being immune in writer E. Jean Carroll’s defamation lawsuit.

    The DOJ cited the legal battle that ensued as to whether their original certification was proper, which held up the case for months. It bounced between multiple courts in New York and Washington, D.C., ending with no clear resolution.

    Citing the recent rulings, the DOJ wrote it “has determined that it lacks adequate evidence to conclude that the former President was sufficiently actuated by a purpose to serve the United States Government to support a determination that he was acting within the scope of his employment when he denied sexually assaulting Ms. Carroll and made the other statements regarding Ms. Carroll that she has challenged in this action.”
    Also, Trump just defamed her immediately after losing the first time. He wasn't in the WH then, so, opinions on immunity don't cover that.

    Well, after starting my new job and having to deal with a lot of older people trying to use technology, that doesn't come to a surprise. Quite a few of his viewers are older and any form of tech that isn't the TV might as well as be magic to them.

    Well True the Vote apparently filed all kinds of complaints with the Secretary of State in Georgia claiming that they'd received detailed accounts of this fraud there and 2000 Mules proved it or something.

    Anyways, the AG's office is now asking a judge to order True the Vote to comply with its subpoena requesting this documentary evidence, as GA investigated the claims and found them to be unfounded.

    A lawyer for True the Vote in June wrote in a letter that True the Vote had already provided some of the information requested to the Georgia Bureau of Investigation but declined to provide the identities and contact information for people described in its complaints “because doing so may put those persons in physical or personal jeopardy.”

    One man falsely accused in the film of committing ballot fraud has filed a still-pending federal lawsuit against True the Vote, D’Souza and others. Surveillance video in the film shows Mark Andrews, his face blurred, depositing five ballots in a drop box in downtown Lawrenceville, a suburb northeast of Atlanta, ahead of the 2020 election. A voiceover by conservative pundit and filmmaker Dinesh D’Souza says: “What you are seeing is a crime. These are fraudulent votes.”

    A state investigation found that Andrews was dropping off ballots for himself and his three adult children.

    If you have proof of a crime, publicly announce that you have proof of the crime, and do not bring that proof forwards, that should be obstruction. A felony. Not defamation, prison, for withholding necessary evidence of a crime -- which, again, you say in public you have.

    Nobody is entitled to this nomination. You have got to earn the nomination.

    Carefully crafted words by DeSantis. "Entitled". "Earn". Not mentioning Trump by name. It's very well done.

    And it won't work. DeSantis needs the publicity of the debates to get his message out. Trump has TV and Twitter. Yes, he'll return to Twitter. Trump knows he sucks at debating and knows he can't answer actual, meaningful questions.

    However, if they have the balls to do it, the RNC can make this work. I don't think they will, based purely on 2016 and 2020 (they're showing signs of breaking form but haven't done it yet), but they could say "we will not support and will not nominate anyone who refuses to debate". It's way too early for Trump to call their bluff. Trump would just show up, call everyone silly names and yell "rigged" into the mic, lose 20 percent and still be the RNC frontrunner.

    The Republican Party knows that Trump is killing them. They know that supporting Trump in 2024 will end in a loss, possibly even worse than Trump's loss in 2020 and Trump's losses in 2018 and 2022, giving Biden the House and Senate for two years. They can stick with him anyhow, they can find a tasteful way to move him off the ticket and keep his voters, or they can throw him out now and hope to recover in time. (They can also pray that Trump goes to jail or dies and spares them the effort, but even Republicans know praying doesn't have a great track record of getting results) Or, they can try to get him back in line -- a risky move with a low chance of success. In theory it's possible. Trump wants to spend other people's money instead of his own, and Trump wants people to chant his name in public. Handling the sociopathic narcisist to make him do what you want is possible. Risky, but possible.
