    They do and they don't.

    Because of International Economic Emergency Powers Act, they can impose tariffs of a national security measure if an emergency is declared. However, it can only be done on an emergency. He did that back in his first administration with Mexico if they didn't help stop immigrant caravans.

    However, he would have to explain why Canada is also part of the emergency. And as far as I can tell, Congress can override it.

    Otherwise, no. Only Congress can declare what can and cannot be subject to a tariff.

    In their appeal against the Colorado lawsuit, Trump's lawyers reiterated that the wording of Section Three does not apply to people running for president and that Trump technically did not swear an oath to "support" the Constitution. Instead, during his January 2017 inauguration, Trump swore to "preserve, protect and defend" the Constitution during his role as president.

    "The framers excluded the office of President from Section Three purposefully," Trump's legal team wrote. "Section Three does not apply, because the presidency is not an office 'under the United States,' the president is not an 'officer of the United States,' and Trump did not take an oath 'to support the Constitution of the United States.'"

    what's interesting is that the only way in which they blew it was to once again underestimate just how many sexists and racists exist in the democratic voting bloc, which strikes me a bit akin to getting high on your own supply.
    2016 and 2024 pretty much conclusively showed that absent every other factor, the collective group of US citizens who regularly vote for the democrats have a not-insignificant number of bigots who just won't show up if the candidate is a not-old-white guy, so really the only thing the DNC could have done is have biden step down and also prop up some other old white guy in his place while *also* maintaining the forms and decorum of their political operation, which basically meant the DNC was in a literally impossible position.

    if we go by voting record, 3/4th of adult aged citizens of the united states are face-down ass-up white male supremacist bigots, full stop.

    That is the thing here. Yes, people voted for Trump that normally wouldn't vote for him because of some bullshit nonsense about the price of things hoping he would cause the price of things to go down(here soon, it will be the opposite). However, and I said it in multiple threads, that there are a sizable number of bigots in the democrat party that, while they have no issue with women voting or working, black people voting or working, they will have an issue with one that is in power. Usually the same people who have a female boss that they don't like. To them, having a female in power will remind them of their boss they don't like and they don't want any part of that.
