Like what is Comey in court for at this point? He is not even indicted.

Because then the DoJ can appeal and have a chance to win because the judge acted to hastily.

Doing things properly so they stand under future scrutiny takes time, one could say the haste with with Bondi brought this case against Comey is the very proof of that. They may well have gotten the full grand jury to sign the indictment if they bothered with it instead of hurrying along.
