We've known that Texas is suing Twitter for some time. There's been a development.

So Texas is trying to force Twitter to keep posts up that violate their terms of service, because it's mostly Trump supporters post death threats, hate speech and racism. Texas is calling Twitter a "common carrier" and therefore they can't discriminate against people who make death threats, hate speech or racist statements, unless they also kick off people of the opposing viewpoint, because Twitter shouldn't be allowed to discriminate.

Another judge just blocked that blocking, allowing Texas to continue enforcing that law, while the lawsuit continues.

That second Texas judge did not rule on the law itself, which only makes sense because quite frankly he can't. This is a blatant First Amendment issue. The government can't force Twitter to keep speech on its platform it doesn't want. The judge just is allowing Texas to enforce it anyhow.

This means, for the time being, Twitter has a few options.

1) Cut off Texas. Which is what I would do, but Twitter probably wants the money.
2) Create one host for everyone who isn't Texas, and one for Texas, and only ban people on the first.
3) Enforce the law equally in all states, and therefore, stop banning people for their opinions which happen to be against the terms of service.

Let's do this hypothetically. Hypothetically, mods, hypothetically.

Let's say, for example, I hypothetically said:

I think Trump supporters should be put to death

MMO-C could not ban me for that. Or, at least for now, I could launch a lawsuit from the state of Texas, under Texas law, and win. Forcing MMO-C to host my statement, even though it quite clearly breaks the terms of service.

They would also have to ban the likely dozens of people responding with "What? What? No, what the fuck is wrong with you?" Because they would be espousing an alternate viewpoint.

So it's both or neither.

Now I'm going to ask @Rozz @Flarelaine and what the hell @Radux how they feel about this, because they are mods and I think their input is worth it, and they have all commented in these forus.

And before anyone brings it up, the fact that Twitter isn't based in Texas doesn't seem to be an issue, so where MMO-C is based isn't either.

Now once again, the lawsuit is ongoing and I really hope Texas loses. The "common carrier" rule should not apply to Twitter, because being on Twitter isn't really mandatory for...anything, except being employed by Twitter. There's also Section 230 which is still the law, and yes the First Amendment. We'll find out eventually. But again, for now, Texas is allowed to enforce a law that says social media companies cannot ban people for posting things that violate the terms of service, if those things can be defended as opinions -- without banning people who take the other side, even if the other side does not violate the terms of service.

I legitimately, honestly hope that dozens, hundreds, thousands of lawyers cite the Trump case as prescedent. For exactly that reason.

Also, I'm hoping that NYState is working with another judge for a no-knock. Because if Team Trump isn't going to willingly comply and isn't going to unwillingly comply, it's time for those special document searchers @cubby has told us about to show up with 20 SWAT members. And the press.

I really hope the NYAG has the guts and the protection to take that next step. Trump is ignoring court orders and subpoenas, to no one's surprise. But he can't get away with it. They absolutely need to go full tilt on him and his organization.

Ah, yes, announcing "I am fighting Twitter so bigly, that I will take on Disney and Amazon too!" That's something sane people do.

Unfortunately...I think this is the last we'll hear of it. Simply put, Trump doesn't have any money and doesn't seem to have friends with money. DWAC stock price rose within seconds of Musk suggesting he won't buy Twitter, but rose back above $40. Not fifty, forty. As in "if you think CyberTrump 2077 can take on Twitter, you've had one too many forties".

Trump doesn't have enough money to make FatFlix. Trump doesn't have enough marketing draw to bring in investors to make FatFlix. I'm not even sure Trump has enough money to compete with The Boys Season 1, so his chance against NetFlix, Disney, or Amazon are lower than his walking speed.

Without investors to spend other people's money on his property, Trump will quietly abandon the project. I mean, look how close he came to abandoning his current one. How many times has Trump posted in the last...let's say "week"? The last one I can find is

Republican Pennsylvania Senate candidate Kathy Barnette on Thursday denied writing a tweet that claimed “pedophilia is a Cornerstone of Islam,” saying that she “would have never said that.”

In an interview with NBC’s Dasha Burns, Barnette, a conservative commentator who is running for the GOP Senate nomination in Pennsylvania, flatly rejected the notion that she had authored the 2015 tweet, despite the fact that the post still exists on her Twitter account.

“Yeah, no, I don’t think that’s me,” Barnette said. “I would never have said that. OK, I would have never said that, because I don’t believe that.”

Barnette’s campaign manager did not immediately respond to The Hill’s request for comment on the denial.

While we learned about this from mandatory filing reports, it is worth noting that this is a clause Trump is highly likely to break. Simply put, CyberTrump 2077 continues to trend downwards. Unless you were one of the original shareholders or bought in the first few seconds, and still haven't sold yet, your stock is worth less now then when you bought it. DWAC has already been dragging its feet to avoid throwing its investors' money into a gaping hole, but now it seems like they're drafting a kind of suicide pact. If DWAC buys but Trump breaks the contract, something with explicit, objective rules in it, DWAC will immediately sue for their purchase price back, burning the stock to the ground and leaving even Trump out money because of it.

The contract Trump in theory will sign if the deal goes through does have exceptions for specifically political posts. Trump will have to claim everything he says is political, which in turn, the judge will laugh out of court.

Did you mean DWAC specifically? Once. Their lawsuit will be a giant public announcement "CyberTrump 2077 is dying and we want our money back". They will use Trump's objective contract breaking (it's written to be as objective as possible) on their way out the door of what is almost assuredly a failed, dying product.

Bear in mind, even without the almost assured destruction of Trump's platform, Trump will have to sign a contract forcing him to use it. That's how bad this platform is. Trump, the one who dreamed it up and said it would take down Twitter, has to sign a contract forcing him to use it.
