some states makes the driver (if drunk or engaged in crimes) responsible for all hurt by an accident - it's entirely possible to be charged for assaulting yourself.

dang that's irresponsible. at least the kid's safe. i honestly hope the court gets the kid better foster parents... unless the parents really take the initiative to improve upon their senseless behavior. this behavior is likely to get the kid in trouble, even in the future. i wouldn't just call it a lucky break and move on.
