It was released in patch 1.9, classic is 1.8 i think.

The likely reason for this is because of Don Rodrigo's Band having Spell Penetration as one of its stats. In Vanilla WoW, Spell Penetration was added as stat on gear on Patch 1.9, the same patch that saw the release of the Gates of Ahn'Qiraj and Ahn'Qiraj raids. Don Rodrigo's, as well as other PvP items such as the Warsong Gulch reputation trinket Rune of Perfection also were released in Patch 1.9.
