U.S. District Judge Alvin K. Hellerstein imposed today’s sentence.

    From November 2020 through early January 2021, LEMKE sent threatening electronic and audio messages to approximately 50 victims, including journalists and politicians, targeting those individuals because of their statements expressing that then-President Trump had lost the 2020 presidential election. On January 6, 2021, the same day that individuals purporting to protest the 2020 presidential election gathered in Washington, D.C., and stormed the Capitol Building, LEMKE sent a series of these threatening text messages to journalists, members of Congress, other politicians, and their families.

    As the attack on the Capitol Building was ongoing, LEMKE sent threatening text messages to a New York City-based family member of a journalist (the “Journalist”), stating: “[The Journalist’s] words are putting you and your family at risk. We are nearby, armed and ready. Thousands of us are active/retired law enforcement, military, etc. That’s how we do it.”

    At approximately the same time that LEMKE was sending threats directed at the Journalist, LEMKE also sent threats to the brother of a New York City-based U.S. Congressman (the “Congressman”), citing the Congressman’s statements about the result of the 2020 presidential election. LEMKE’s text messages, which included a picture of a home in the same neighborhood as the home of the Congressman’s brother, stated:

    Your brother is putting your entire family at risk with his lies and other words. We are armed and nearby your house. You had better have a word with him. We are not far from his either. Already spoke to [the Congressman’s son] and know where his kids are.

    . . . your words have consequences. Stop telling lies; Biden did not win, he will not be president. We are not[] white supremacists. Most of us are active/retired law enforcement or military. You are putting your family at risk. We have armed members near your home. . . . Don’t risk their safety with your words and lies.

    LEMKE acquired and used at least three different phone numbers and various electronic accounts to mask his identity when sending threats to his victims. LEMKE was not in fact affiliated with law enforcement or the U.S. military as he claimed in some of his threats. On or about November 7, 2020, LEMKE posted to Facebook: “Folks. Be ready for war. Trump has refused to cede. Evidence shows fraud occurred and the Supreme Court cases will be successful. We blockchained and watermarked ballots in 16 states. Trump will prevail.[] Spread this message. . . . FAITH my fellow Republicans. Do not give up.”
    And 3 years of supervised release after he serves his sentence.

    @cubby I have a question about the Proud Boy who pled guilty yesterday to conspiracy. Would that mean there was prior planning before the insurrection took place? Something a certain group of people has been denying for close to a year?
    I'll be curious to see if they start issuing criminal contempt charges for Members of Congress who refuse to submit to the Jan 6 Committee subpoenas.

    The guilty pleas to conspiracy are very interesting - and it's a good question. The DoJ prosecuting attorneys should be on top of the "big picture", and if they are seeing both deep and clear conspiracy threads, I would expect there are larger/bigger targets in their crosshairs.

    They are indeed, but to grab peeps with just the RICO charge, the prosecutors first have to convict/plead someone of RICO charges. Only then can the federal RICO statue kick in and they can start grabbing people based solely on the RICO conviction. It's a weird statute, but I love it. I kinda wonder if they are eyeing Trump with this at some point.

    The Biden Administration pushed back on some document requests by the Jan 6 House Committee.
    The House select committee investigating January 6 has stood down on its requests for some documents from the Trump White House, after the Biden administration convinced the panel to scale back its pursuits.

    As a result, the committee won't be getting hundreds of pages of National Security Council records. But the documents may not have been all that helpful, anyway.

    Of the 725 people arrested so far for the January 6 insurrection incited by Donald Trump, perhaps one of the most telling stories is that of the very first person sentenced, Anna Morgan-Lloyd. On Facebook, Morgan-Lloyd's attitude about participating in a violent attempt to overthrow democracy was jubilant, declaring it the "best day ever." But, when faced with the possibility of prison time, she masterfully escaped punishment by pretending to be reformed. After talking up all of the studying she did in jail about the importance of democracy and evils of fascism — she even claimed to have watched "Schindler's List" — Morgan-Lloyd turned on the waterworks.

    The act worked. Morgan-Lloyd was let off with a slap on the wrist, getting probation with no prison time. The judge seemed to sincerely believe her tale of being fooled into fascism and finding redemption through the magic of learning. This is why he was furious later to learn that Morgan-Lloyd's gut-wrenching show of remorse was all nonsense. Indeed, it was only a day after she was handed her light sentence that Morgan-Lloyd was telling lies on Fox News, saying "we see nobody damage anything" and the rioters were "actually very polite."

    In reality, the rioters did $1.5 million in damages, injured nearly 140 officers, and were so out of control that five people died on the scene. Many of the officers who defended the Capitol from the violent mob are still paying the price one year later. Six months after the insurrection, 17 were still on leave due to injuries. Four have committed suicide in the past year. As officer Michael Fanone testified about that day, "I'm sure I was screaming, but I don't think I could even hear my own voice."

    So was Morgan-Lloyd just delusional? Did she not have eyes in her head? Was she unable to see the violence plainly visible in the overwhelming amount of video and photographic evidence of the day? No, of course not. As the judge who sentenced her later noted when issuing a harsher sentence to another rioter, hopes that her contrition was real were quickly "dashed."

    The lesson here is clear and should remain clear: Fascists lie. That is the nature of the authoritarian ideology, which doesn't value good faith discourse in a democracy. Indeed, they spit on democracy, or, as rioters in the Capitol reportedly did, they shit on it. All that the fascist respects is power and domination. Lying, if anything, is valorized in the authoritarian ideology because lying is an expression of power. To lie to someone else — a judge, a journalist, randos on social media — is a display of dominance over them and contempt for their petty attachment to Enlightenment values.

    This is a refrain I've been talking about for a while. The complete lack of any actual ideological principles beyond a clutching need for power and control, and thus a willingness to do anything to secure that. Lying is the cheapest possible tool to use, and since they have no principles beyond seizing power, they have no moral objections to lying. It costs them nothing they value, and has a strong chance of gaining them something in return. Not only can't you expect them to avoid lying, you can expect that they will always lie, about everything. Narrative and rhetoric simply matters more to them than facts or truth.

    And like we're seeing; it isn't a few manipulators at the top that do this. It's the entire movement, every single person involved, at any level. That's why Tucker Carlson getting caught out being a lying sack of shit doesn't cost him viewers; they all know he's lying, but they don't care, because they prefer the lie. He's not betraying them, he's serving them exactly what they want. Same for Trump; all those lies were positive factors for his supporters, because those lies led to seizing greater power, and that's literally all they care about. That's why Trump talking positively about vaccines got him booed, recently; that's not the narrative his supporters want. They want their stories, not truth. Truth doesn't help them.
