    Blizzard dont own the word diablo its a spanish word for the devil, its probably been around since the spanish language was created or even well before that in some sense of the word.

    I can see there being some merit since both are digital entertainment media so there could be some legit confusion.

    But once you go past digital entertainment media to just entertainment media in general there are many diablo characters, some of which have made/are making the transition to digital formats too.

    sounds like a case that will be decided on technicalities.

    you can't "just" trademark a common word, you have to trademark it in a specific context.

    this will be about if "video games" is a different enough context from "tv show".
