    With the Roe v. Wade Decision Looming, Employers Are Rethinking Hiring in Certain States

    Companies want to offer health benefits to female employees, but doing so may mean being selective about where they hire.

    With the landmark Roe v. Wade decision now seemingly on thin ice, supporting your female employees' health decisions is certainly more complicated and potentially legally dicey. So it makes sense that some employers are reconsidering where they hire workers.

    That's true for Chelsea Cohen, the co-founder of SoStocked, a St. Louis Park, Minnesota-based inventory management system. She says the company is going to focus on hiring employees located in state, where abortion is legal, while figuring out how to cover costs for current out-of-state employees.

    It's an unenviable position. After all, employers oftentimes just want to hire the right person for the job, without regard for where that person is located. But doing so under such constraints can also pose an unenviable risk.

    The cost of covering the procedure have ticked up in recent years. The median charge for an abortion from 2017 to 2020 was $560, which has since increased to $575 for abortions performed during the first trimester and $895 during the second trimester, according to an April 2022 study published in Health Affairs. These prices will only increase with more regulation.

    Travel prices are also skyrocketing with record high fuel prices, rental car shortages, and pilot shortages hitting the airline industry. The U.S. currently harbors 27 abortion deserts, or major cities where people must travel 100 miles or more to obtain abortion care, a number that will increase if Roe is overturned.

    San Francisco-based credit card company TomoCredit is one company willing to front the bill. The company will pay $5,000 of legal expenses related to anti-abortion laws, $2,500 toward travel expenses, and up to $2,500 for out-of-pocket medical costs, says Kristy Kim, founder and CEO of the company. That's $10,000 total for any employee who needs to take them up on the benefit. While for some companies that's easily feasible, for small businesses on tight budgets, doing so may not be possible.

    Keep in mind that most companies will also have to seek legal counsel to wade through various state laws, especially for employees located in states with strict aiding-and- abetting statutes like Texas. Such laws, which can result in costly lawsuits, can make it difficult for small businesses to run their businesses and recruit the most qualified candidates, says Burton M. Goldfield, president and CEO of TriNet, a Dublin, California-based professional employer organization for small and medium-size businesses.

    "We regularly guide our customers through the complexity of multi-jurisdictional hiring and there is no doubt that decisions about where to invest and grow are influenced by laws that can have a negative effect on the business community," says Goldfield.

    And it will only get more complicated if Republicans attempt to create a nationwide ban on abortion travel. While that scenario isn't certain, there is a chance the party could regulate travel for abortions based on the Commerce Clause of the Constitution. Doing so would outlaw interstate travel for the purpose of performing an abortion, or obtaining one, says Seth Chandler, professor of law foundation at the University of Houston Law Center. Such legislation could conceivably be upheld as constitutional if Roe is overturned.

    One way to restrain costs is to set up a Health Reimbursement Arrangement to support eligible expenses. With this arrangement, an employer can allot a set amount for employees to use on medical expenses they choose, in a tax-advantaged account-based health plan, says Jason Fan, co-founder and CEO of Forma, a San Francisco-based benefits platform. This can include expenses such as travel, accommodation, meals, and lodging. Companies can also cover the costs of a legal abortion procedure (in a state where it remains legal) through the funds. Though Fan strongly recommends employers check with their medical plan insurance carrier or third-party administrator before doing so.

    Man arrested outside Kavanaugh’s house charged with attempted murder
    A man was arrested outside the Maryland home of Supreme Court Justice Brett Kavanaugh early Wednesday morning after making threats against the justice.

    The man was identified in a criminal complaint as Nicholas Roske, a 26-year-old Californian who was taken into custody without incident after calling 911 on himself. According to officials, Roske was carrying a suitcase and backpack that contained a tactical vest, knife, pistol, ammunition, pepper spray, zip ties, a hammer, screwdriver, nail punch, crow bar, pistol light, duct tape and hiking boots.

    Roske was charged with attempted murder of a Supreme Court justice. According to the affidavit, Roske said he “began thinking about how to give his life a purpose and decided that he would kill” Kavanaugh after finding his address on the internet.

    “At approximately 1:50 a.m. today, a man was arrested near Justice Kavanaugh’s residence,” a Supreme Court spokesperson said in a statement early Wednesday. “The man was armed and made threats against Justice Kavanaugh. He was transported to Montgomery County Police 2nd District."

    Kavanaugh’s home was the site of peaceful protests following a leaked opinion last month that would result in the overturning of Roe v. Wade, the 1973 ruling protecting abortion rights. If the final ruling is in line with the draft, Kavanaugh is one of the justices voting to gut abortion access for millions of people around the country. The Senate quickly moved to pass funding for more security for the nine justices, who have lifetime appointments.

    “House Democrats must pass this bill and they need to do it today. No more fiddling around with this, they need to pass it today,” Senate Minority Leader Mitch McConnell said on Wednesday following the man's arrest. “Before the sun sets.”

    When asked about the arrest at a press conference Wednesday afternoon, Attorney General Merrick Garland said, “This kind of behavior is obviously behavior that we will not tolerate. Threats of violence and actual violence against justices of course strike at the heart of our democracy. And we do everything we can to prevent them and hold people who do them accountable.”

    White House press secretary Karine Jean-Pierre said at Wednesday's briefing that President Biden “[condemned] the actions of this individual in the strongest terms.”

    The Washington Post first reported that the man was angry about the leaked draft and “over a recent spate of mass shootings.” The Supreme Court is also expected to rule against a New York law making it more difficult to carry a gun outside the home — an expansion of the Second Amendment even as polling shows American wants stricter gun laws.

    The arrest affidavit says that, at 1:05 a.m., June 8, 2022, two United States Deputy Marshals saw “an individual dressed in black clothing and carrying a backpack and a suitcase” get out of a taxicab in front of Kavanaugh’s home.

    Roske is accused of saying that he was “thinking about how to give his life a purpose and decided that he would kill the Supreme Court Justice after finding the Justice’s Montgomery County address on the Internet.”

    The affidavit alleges that, when Roske got out of the taxicab that stopped in front of Kavanaugh’s residence, he looked at two deputy U.S. Marshals who were standing next to their parked vehicle and then turned to walk down the street.

    Shortly thereafter, a man who said he was Nicholas John Roske called the Montgomery County Emergency Communications Center and said he was “having suicidal thoughts and had a firearm in his suitcase,” according to the allegations in the complaint.

    He told the call taker he came from California to “kill a specific United States Supreme Court justice,” the court records contend.

    Authorities responded and arrested Roske.

    Roske “further indicated that the had purchased the Glock pistol and other items for the purpose of breaking into the justice’s residence and killing the Justice as well as himself,” the affidavit says.

    Patricia McCabe, the Court’s public information officer, told Heavy in an emailed statement, referring to Wednesday, June 8, 2022:

    At approximately 1:50 a.m. today, a man was arrested near Justice Kavanaugh’s residence. The man was armed and made threats against Justice Kavanaugh. He was transported to Montgomery County Police 2nd District.

    Montgomery County police told The Washington Post that they responded to a call for service near Kavanaugh’s home in Chevy Chase, Maryland, and arrested the suspect.

    They believe he “came in from out of state with the intent to kill Kavanaugh,” Shiera Goff, spokesman for the department, told The Post. He was in the area between 1:14 and 1:45 a.m. on June 8, according to Goff.

    The suspect did not make it inside Kavanaugh’s home. It’s not clear whether Kavanaugh or his family members were inside the home at the time.

    Roske is scheduled to have an initial appearance in U.S. District Court in Greenbelt at 3 p.m. June 8, according to a press release from the U.S. Department of Justice, announcing the charges. He faces a maximum penalty of 20 years in federal prison.

    According to CNN, he told the judge he had taken medication he did not specify

    Roske told authorities he was “upset about the leak of a recent Supreme Court draft decision regarding the right to abortion as well as the recent school shooting in Uvalde, Texas,” the affidavit says. “Roske indicated that he believed the Justice that he intended to kill would side with Second Amendment decisions that would loosen gun control laws.”

    Montgomery County Police told Heavy in an emailed statement:

    At 1:42 a.m. Montgomery County Police Department responded to a call for service in the area of Supreme Court Justice Brett Kavanaugh’s home in Chevy Chase, MD. An adult male from California was taken into custody by Montgomery County Police and transported to a Montgomery County police station. The case was transferred to the FBI. We are not able to release any identifiers on the suspect or whether he had a gun, that information will be provided by the FBI.

    The recent mass shootings in the United States have included the elementary school shooting in Uvalde, Texas, and a mass shooting at a Buffalo, New York, grocery store.

    A person who knew Roske in high school told Heavy, “None of his high school friends can believe it. He’s a good person,” before declining to speak further.

    The affidavit says that authorities searched Roske’s suitcase and backpack and found the following items: A black tactical chest rig and tactical knife, a Glock 17 pistol with two magazines and ammunition, pepper spray, zip ties, a hammer, a screwdriver, nail punch, crow bar, duct tape, hiking boots with padding on the outside of the soles, and other items.

    Maryland’s Governor Larry Hogan wrote in a statement posted to his Twitter page that the Supreme Court Justices have had heightened security at their homes since May 2022. He wrote:

    Early this morning, I was briefed on an incident that occurred near the residence of Justice Brett Kavanaugh and his family. I want to thank the US Marshals Service and Montgomery County Police for acting quickly to apprehend the suspect and prevent him from causing any harm. Maryland State Police and the Maryland Coordination and Analysis Center are providing assistance with the investigation.

    The heightened security at the homes of the justices began after a request Governor Youngkin and I made to Attorney General Garland last month. We will continue to partner with both federal and local law enforcement officials to help ensure these residential areas are secure.

    In May, Axios obtained an internal Department of Homeland Security memo that discussed rising threats against SCOTUS in the wake of the Roe v. Wade leak.

    The threats, that also targeted politicians and others “are likely to persist and may increase leading up to and following the issuing of the Court’s official ruling,” Axios reported, quoting the memo.

    The memo reported that threats were coming from people both opposed to and supportive of abortion.

    “Some racially or ethnically motivated violent extremists’ embrace of pro-life narratives may be linked to the perception of wanting to ‘save white children’ and ‘fight white genocide,'” the memo said, according to Axios.

    “…the memo warns that this time, extremist acts could come from abortion-rights proponents as well,” Axios reported.

    NBC News also obtained the internal memo and reported that the National Capital Region Threat Intelligence Consortium “has identified at least 25 violent threats on social media that were referred to law enforcement agencies for further investigation” since May 2, 2022.

    “Some of these threats discussed burning down or storming the U.S. Supreme Court and murdering Justices and their clerks, members of Congress, and lawful demonstrators,” the memo said, according to NBC, which reported that “the authors also noted several social media accounts that encouraged violence at abortion-rights rallies…”

    In Madison, Wisconsin, in early May 2022, a group that supports overturning Roe vs. Wade was firebombed. “If abortions aren’t safe, then you aren’t either,” a message was scrawled on the wall by a group calling itself Jane’s Revenge. In early June, a Christian pregnancy center that opposes abortion was the target of arsonists who wrote “Jane was here,” Fox News reported.

    Thanks for the links, yeah it appears he was not happy with how the abortion thing was going to go it seems so far that his main issue was with gun control though. On the second link, not shocked to see them take Shumer's words like that. He was obviously not talking about wanting the justices murdered, but right wing is gonna do their usual routine. At this point though I do agree with the extra security though if that is all it is. If the two Marshals had not been there this could of been really bad.

    Yeah sounds like he saw the two marshals got spooked and then called. Dude just fucked his life away, they will throw the book at him and with the zip ties/tape and shit they are going to be able to charge him with a lot of different things. All he did was give the republicans something to try and pivot away from after all these mass shootings.

    If he has confessed then he's basically fucked. It will depend on how it plays out, but also on some level, we want them to throw the book at people like this in general. We want our SCOTUS Justices protected, despite where they are taking the country.

    Because if we start being ok with violence making the changes, then we're already done as a democratic republic.

    A lot of people on this forum were not concerned and were actually happy that the media was releasing Supreme court justice's addresses and telling people to go and protest. Since this is the kind of protest that was rampant in Seattle and Portland, I do not see why you guys are surprised.
