    And they can. If this block is taken down by the tribunal, the case simply goes back to the CMA that can block it on different reasons.

    No that's not how it works, CMA can't just make up a new argument, the CMA choose the Cloud gaming market hill to die on, that's it

    If they could, they wouldn't have had to ask the Judge and the judge wouldn't have the ability to stop it, he flat out denied the CMA request and told them to go pound sand

    Eh I think you misunderstand. They cannot brink that argument NOW during this tribunal. If the tribunal takes the block down, the judgment goes back to the CMA but it doesn't force them to issue a positive ruling, it simply requires them to present a new ruling.

    No actually it seems that I have a better understanding than you do, no matter what, the CMA NEEDS a Theory of Harm (ToH) to block, the entire goal with this appeal is for CAT to throw out the cloud gaming market ToH (which is the only theory of harm the CMA has)

    You seem to be under the belief that the CMA can make up new numbers to try to block, they cannot which is why they have the CAT appeal in the first place. If CAT remits to the CMA and throws out the cloud gaming market argument, that's it, the CMA has no choice but to clear the deal

    You literally have no idea what you're talking about lol

    Don't even bother with curbstomp. The guy still doesn't get a CAT appeal bounces the case back to the CMA to re-evaluate under the new parameters set by the appeal. It doesn't magically approve the deal. This has been explained to him multiple times in this thread but the dude only reads MS astroturf twitter accounts so it's like talking to a wall.

    A successful appeal just bounces the issue back to the CMA for further review and new evidence CAN be presented and a new ToH can be formed. This DID happen with the Meta/Giphy merger; Meta successfully appealed to the CAT, then the CMA issued a new ruling which held on second appeal.

    Nope, again zero idea what you're talking about, Meta was remitted back to the CMA purely because of a procedural error, none of the ToH in the Meta/Giphy (I believe there were 3 of them) were thrown out by CAT

    A ToH was tossed out in the Tobii case but that case had 3 ToH and Tobii got nailed with the other 2

    MS/ABK has 1 ToH, once its gone that's it

    You don't even research any of these cases, you just talk and embarrass yourself

    Rare has been very successful with Sea of Thieves and Bethesda just came out with Hi-Fi Rush and soon Starfield. Microsoft game studios has been slacking as a whole but not because of those two.
