Joe Biden could try to pass a constitutional amendment that puts a term limit of 18 years (not retroactive) in place for Supreme Court Justices, sets the number of Justices to 9 and limits the number of confirmations to the Supreme Court that each Congress can do to 1. Then, in time, one Justice will be replaced for every Congress, and if somebody stalls the process that doesn't really matter, because they can only nominate 1 in the next Congress anyway. Each President would have the opportunity to nominate at least 2 Justices, at most 4 if re-elected. Presidents would not be incentivized to nominate young (relatively speaking) nominees for their pick to serve for ever-longer terms, but have a larger spread of ages that are viable as a choice allowing them to choose the most qualified individual. Wouldn't that be something? Too optimistic an outcome? Probably.

I would definitely like to see this particular reform, i.e. one justice per Congress and the oldest one rotates out. I would have no problem with the Dems expanding the court when they can, but they should also include reform as part of the package.

2016 was won because of many issues, but "muh economic anxiety" wasnt one.

Also, latest polling shows Biden 9 points ahead of Trump. And what's with RCP lowering the biden spread by so much? RCP average is 6 points but he's consistently polled 9-12 points ahead, apart from Rasmussen?

And after that (and after packing the courts), pass legislation re-instating the 60 vote mandate, state that SC seats cannot be increased further... and do something to ensure that they represent the society they are in.

Its pretty simple. Democrats need to play as dirty as republicans do, and in this case it means expanding the size of the supreme court. We all know that if the places were reversed that is exactly what they would do with no qualms at all. Democrats need to do the same because otherwise the republicans will gradually turn the country into a authoritarian police state because in the medium to long term they sure as hell don't have numbers to hold onto power democratically.

Personally, I would like to see Trump in handcuffs along with Pence, his entire administration to follow and a thorough investigation into every bit of maleficence and corrupt action taken by Trump and everyone who took a bribe.

What Trump has done has reach way beyond him, and for this country to have any credibility going forward I think this is a must.

Apparently both Romney and Murkowski have committed to NOT confirming a new Justice until after the inauguration.

Hmm that's interesting. Collins is trailing in her relection bid but if she does the same then she might be able to hold her seat. She needs a hail mary right pass now and I can't think of any other one that might come along between now and Nov.

But I still think they'll ram through another justice and Biden will need to expand the SCOTUS.

We also have to consider that if the Senators don't vote prior to the election, they can still fill the seat during the lame duck session. IIRC, nothing actually prevents that from happening.

It will be so damn interesting to see upcoming senate race polls. Never underestimate McConnell, but this is not necessarily a disaster for democrats. The GOP is certainly sweating right now.

And even if Trump/McConnell get someone in, it will give plenty of ground to democrats to expand the court, which might even lead to the depoliticization of it. Just saying.
