Legally he may have a point. Practically, I think it would be a bad precedent to set. Many games gain the majority of their popularity from streaming. With the exception of heavily story driven games, watching them really doesn't give the full experience, so I think it's reasonable to assume that more sales are won than lost by allowing streaming. There's a reason that the big companies haven't done it yet. If the AAA industry thought there was money in it, they'd have done it long ago.
Greed kills industries. Happens all the time. An industry might start by accident out of pure enthusiasm for a very fun, free activity. It catches on and suddenly its a cottage industry. Corruption sets in. People look for angles to copyright and claim aspects of the industry so they can erect barriers and paywalls to generate cash. It becomes harder and harder to enjoy the content as it gets stuffed with advertisements and propaganda. Directors and CEOs start banning and suing people to protect their revenue streams. Eventually, the industry collapses as people get fed up and look for an alternative activity that is free, fun, and built on pure enthusiasm. Thus the cycle begins again.
Imagine giving a fuck about opinion of somebody from STADIA, OMEGALUL.
while technically right, it does not make it practical. Most companies see the free marketing by the streamers as a good thing, given it can drive sales of their actual game (see: Fall Guys, Among us, Apex Legends, etc...).
so what, extort the little streamers to not copyclaim them, and then pay big bucks to the big streamers for promotions? sounds like a plan.
There is no evidence that streaming a game hurts the sales of that game unless it is already bad game. A good game will never get hurt. Latest examples are fall guys and among us.
Its free marketing.
Skate 3 had to print new copies back in 2014 just because of pewdiepie.
You can even add WoW to the list cuz of Asmongold. Tons of new players join cuz of him.
DRAGONFLIGHT BETA CLUB
not if they are giving the license away for free. which currently the vast majority of studios explicitly do because of the advertisement/PR benefits. so if you wanna go against the grain (like nintendo until recently) the result is just that people don't stream your games instead of pay you.
Stuff like that is going to make pewdiepie a target. He is making advertising firms look worthless. Why pour money into your marketing department when you could just hire pewdiepie or someone with that sort of influence? Someone is gonna get him discredited and banned because he is upsetting the current order of things.
I'm sure this point would work for some things, but this would really hurt Indie games like Among Us. That game never would be popular without streamers & YouTubers. Same with Five Nights at Freddy's or Undertale.
Yeah, everyone knows how much streaming hurts the game industry! Which is why they pay them the big bucks to play their games.
I especially think the Fall Guys people and even more so the ones behind Among us REALLY hate streaming. How dare they make them sell millions of copies? Damn leeches!
sure thing. https://www.blizzard.com/en-us/legal...d-video-policy
What this means
As a community content creator, you are permitted to create video productions using Blizzard's Content, and to distribute them freely on your website, or on other websites where viewers can freely view your Production.
It's free advertising honestly and no different from Let's Plays, Walkthroughs and entire clipped sections of the game posted on video sharing sites or in text form and tends to drive up sales for your game. I mean take a look at Among Us blowing up after two years of significantly small customer base. Not to mention technically the Streamers have already bought a "license" for the game considering that's how ToS and user agreements and such phrase it now. They no longer let you "own" a copy (unless you bought the game from GOG) and have licensed it to you instead and in that agreement they allow you to stream or record it as long as the end product footage isn't pay walled.
Edit: I should also add that's the reason why Ubisoft's recent update to their ToS is rather controversial, they basically act as if you've been "hired" by buying their games' "licenses" and so your footage is technically their footage and if it reflects poorly on their company image they have the right to "fire" you at any time.
Though I have wondered how his logic would work with F2P games if AAA companies suddenly thought charging people for every viewer/minute of their stream was a good idea to stop getting their stuff streamed immediately. Like imagine if LoL, Apex Legends, Fortnite or World of Tanks suddenly demanded for every 100 viewers who watched for 10-30 minutes of your stream then you owed them like 20$ in royalties or something.

But they do, the user is signing an EULA on installation or first run. If companies were really upset about it, they'd add clauses regarding streaming; they don't, because streaming and other recording of gameplay benefits 99% of games released. The real truth is the streamers should be paying the developers and publishers of the games they stream. They should be buying a license like any real business and paying for the content they use.
If you are particularly bold, you could use a Shiny Ditto. Do keep in mind though, this will infuriate your opponents due to Ditto's beauty. Please do not use Shiny Ditto. You have been warned.
