I think FOX News is almost certainly correct. Tucker has attempted to get out of his contract before, claiming FOX News broke it, in this May 9 article. Best of my knowledge, no court upheld that claim. And I doubt FOX News left in "oh, but you can do whatever you want on the interwebs" that would let him out.
