You don't own anything on your account, so you can't really legally sell it.

they will ban the account if they find out.

He's using that exact rule on the EULA to get the account banned on purpose and pretty much just scammed some dude out of his money, is what he's saying.

You could be sued. Whether the lawsuit would be successful is another thing entirely. What you describe isn't really uncommon (original account owner gets account banned after sale), and I've never heard of such a lawsuit.
I doubt the buyer would take action against him anyway, considering it's probably some gold seller.
And if not, he's probably going to get hacked anyway by one at some point lol

You can always get sued, specially if you live in the States. If the person who sues you will win is a different question entirely.
I don't think it is likely as technically you're not allowed to either sell OR buy a wow account.

My guess is that Blizzard will just ban the account if they find out. I doubt they will be sueing everyone who sells their account, it's not worth it. The guy you sold it to might have the possibility to sue you if he thinks it's worth it but I am not a lawyer so I don't know for sure. Maybe he won't even stand a chance because he could have known that it was an illegal transaction. I don't know if it's up to you to tell him what can happen when you are making an illegal sell. Maybe he can try to get his money back, I don't really know.

Asking if you can be sued because you sold an account is exactly the same thing as asking whether you can legally sell an account.
Whether that account gets banned or not makes no difference whatsoever.
No, it's not legal to sell something you do not own; Blizzard owns your account, not you. If you sell Blizzard's property, it's not exactly legal, now is it?

Unsure. You don't own your account (you pay for the privilege to access it) so you've technically sold someone elses property to another party.
However, it takes one kind of person to sell an account. It takes a special kind of person to sell it, then get it disabled, purely for the monetary gain.
