Gaetz doesn't have the benefit of a friend in the White House who is happy to pardon him. Hell, he's apparently even too toxic for Trump at this point.

Because Trump was POTUS dude, you can't prosecute a sitting president. His testimony was used to impeach Trump (the first time), but he can't help that impeachment is a political process and not a legal one. What Gaetz is facing is a legal process, not a political one.

We have investigations ongoing that have spend up a bit since he left office, like the SDNY case, but like, it's not as simple as you seem to want it to be.
