No, it wouldn't, because PvE content doesn't scale your item level up. And I would not be surprised if this gets fixed in PvP pretty fast too.

it worked on mop beta tests, was tanking with thunderfury scaled up

Even though its nice to have a legendary it would be just stupid if the scaled.
We would see people running around with legendaries more than MC freebe mounts in a while.
Edit: sure someone will "herp derp there are no more legendaries cos they scale up!", I meant that if they do scale up everyone who got them will use them, that means that as soon as you are in a crowd they will carry them and the 'legendary feel' goes up in smoke.
Older lgendaries should be just that, something players equip from time to time to make their epeen look better outside AH during some downtime. They should never ever be scaled
