The last few CEs have applied the pet directly to the account that the CE is applied to; they haven't been separate codes for quite awhile now.

By having a CE on your Battle.net account, same thing as with WoW and SC2 CEs. It's not a separate code, the game code that you get with the CE is a code specifically for CE buyers and flags your account as owning the CE, thus you get all benefits.

TL;DR, no, you won't be able to get your friend's pet unless you gave him a normal code and he gave you his CE code. If you have the annual pass - you can't do this, unless you bought yet a second copy. O_o

I find that really Perplexing, you can always take it up to a disupte level, provided you got your reciept of purchase or depoist

Its how i got my Cata CE after a long wait!

They are coming out with a "Starter Edition" of D3 30 days after release. It should have the same content as the passes.

Grats. Getting mine in 2 weeks I guess, the site I ordered from ran out of them.

Though I got D3 with annual pass so it doesn't matter that much.
