Need more context. Basically, if they deserve it, fair. If not, childish. However, that (in my mind) tends to apply more on a corporate level than an individual level.

Most of the time people get ddos'd due to the victim of the attack treated them like shit, or rather they are trying to get even with them.

Then you have the idiots who ddos to win at PvP. (RBGs for example)

If you try to DDoS a game server, most times an automatic system will step in to stop it, or a network admin will. Unless you've got a large network for yourself, even an amplification attack won't be enough (considering the speed of home connections) to bring down a server.

On wow it's not the servers who are DDoSed, but directly the player, you just have to find his IP wiich is sadly not that hard with people using Skype for arenas.

Getting caught or not is irrelevant. It is still illegal. Some murders are never solved too. Does that somehow make it more right/fair then a murder that was solved? NO.

DDoS attacks deny someone a service they paid for. Defending them as 'fair' because someone said something mean is like defending pouring sugar in someone gas tank, cutting their phone line, or burning bags of shit.
