Most of you in this comment thread are so vicious and hateful, and have no compassion for what it is to be assaulted. Unfortunately, many women you know have lived through this, and your hateful words not only put down this woman, but the women close to you who are too fearful to speak up and find healing because of your judgements.
Try learning the laws, maybe talking to a rape crisis center to get a grasp on compassion. Yes, if you commit a crime while drunk, you are responsible. However, you always have a right to your own body, and with out a stable mind due to intoxication or being drugged, no one has the right to take advantage of your body, male or female.
As for if the other is drunk. Many rapists have that m.o., and courts and judges know that. There are predators in the world who are going to seek out victims. One way for them to get away with their crimes is to get themselves intoxicated first. Most people in the community just look at them as being sloppy drunks or alcholics, and having the wool pulled over their eyes that this is actually a predator.
So, the rule of thumb...it's the intention behind the person accused. If he or she is going into a "date" situation with the intention of getting sex after the drinking has begun, while the other person has made no intentions of doing so, the court views it as rape even though both parties are drunk. It's extremely difficult to prosecute these things, it usually takes a group of women banding together and fighting the predator in court, rather than a lone single voice.
Just because a woman doesn't fight someone off, does not mean it was not rape. There are many survival techniques, and no one knows now any one will react when a violation of the body is happening. If she is has had drugs mixed into her alcohol, she could actually be in a "black out state" where none of her behavior is registering in her conscious mind, and is actually acting extremely out of her normal behavior. This usually happens when predators mix sleeping pills into alcohol.
It is so terribly sad that our culture is almost always on the side of blame the victim. And now growing on the side of, hey, post that crap to the Internet as soon as possible, so everyone can humiliate and berate the victim. It's time we all take a look at the true rape culture.
I know it's hard, because to do so means you are going to discover you probably actually know a few rapists, and that's a tough pill to swallow.
