The game is fully playable because it isn't a server based game. The person hasn't broke any laws by popping the disc in and playing it. There really are no laws about this stuff anyways. The way it is controlled is the retailer and distributor sign contracts stating they won't sell the game prior to X date. If they do they will face fines. A customer that plays the game prior to release date won't face any trouble unless they work for one of the companies that sells or distributes the game.
They could argue posting "copyrighted" information in any lawsuit but that wouldn't likely hold any ground given the trial would go past release date and HG would have to continue to enforce it prior to release in order to continue a case against the person.

You probably never lived in the Eastern Europe/Russia In our area the law always finds a way, if the right person wants somebody to be sued, you just need the money, the right people and there you go, it's really flawed. Even in my country - Poland - it happends all the time. There is always a way, even not related to the real reason :P The same goes other way - many bad things go unpunished. It just really depends on who you are, who you know and how much money you have.

I'm sure it'd be fun for a while, but the issue that comes to my mind about this is that it's essentially spore without the ability to make anything.
Basically, everything you see is spat out by a computer program, and while things like animals and plants and so forth might start out looking new and unique, you'll eventually start to see the same basic type of creature and plant, and eventually planet, repeated over and over again.
It's like exploring in Minecraft (or in spore, for that matter.) Am I really going to find something I've just legitimately never seen before? And if I do, how unique is it? Is it just a slightly different variation of a six-legged fishdog that I've seen 20 other times on 20 other planets? Is an eight-legged fishdog that much different than a six-legged one?
And then there's the procedural generation aspect. Eventually, you start to see that no soul went into making this six-legged fishdog beyond the initial individual components that the artists made. A computer code tossed it around for a bit and out tumbled an animal. Same with landscapes. The first time you see some grand, sweeping arches that would be impossible on earth you might be impressed, but by the fourth or fifth time you see it on another planet... you start to realize the curves seem to curve in this one particular direction, and that certain constants define the parameters of what make everything up.
That's when procedural generation's soullessness starts to rear its ugly head. You see it in Minecraft, you could see it in Spore (and that had a great deal of user-made content of varying qualities) and you'll likely be able to see it in this after a time.

Thanks for the elaborate response. I haven't played spore but I have played Minecraft. I certainly hope that it's got story to it. What I'm gathering from your post without knowing too much about the game is that the big concern is that this is just going to be a series of randomly generated planets that have no story to them and eventually will just become a mash up of things we have already seen on other planets in some fashion or another.
What I've been led to believe is that it's a game with free travel where we explore and find different planets that have their own history and story and all..and I was hoping that we get our own story as well. Am I completely off? Just a heads up I have not been watching gameplay or anything to keep from spoiling so excuse me if this is commonly known stuff.
Unfortunatelly there is no story. Also the intelligent life will be a very rare discovery. According to the No Man's Sky wiki:

Species are procedurally generated

Most planets wont have any life forms on them and from those that do, it will be primitive life forms.
Sentient life forms will be rare and considered a good discovery.
Like I said, many people unfortunatelly assume too much because of the Hello Games's makerting of not showing enough + hiding things or barelly mentioning them, which creates alot of understatements so people know almost nothing and begin to assume x, y, z and this makes them buy the game out of curiosity and false hopes.
I feel sad for anyone who will be severely disappointed because of the overpriced, badly advetrised product. 20$ is max I would pay for this.

Shame I missed the clips before they got taken down, they'd probably be something that would confirm either way if I wanted the game or not.
I understand them not wanting to release too much about the game, but I still haven't seen sod all enough to decide if I would be tempted.

I do find something funny from reddit, that if you watch one or two planets the game is spoiled for you. The other 18 bazillion planets mean nothing after being spoiled seeing the first one or two.
Seems they are indeed hiding a bit of something. Maybe how repetitious it could be. Some is fine. Too much and it isnt good.
